KENNER, La. (WVUE) - The attorney for former Saints wide receiver Michael Thomas said the double-misdemeanor case against his client was dismissed Wednesday (March 20), but Kenner’s city prosecutor and police department said that is untrue.

“After reviewing the evidence and reports, there were no injuries or damages, and no videos to support the charges,” Thomas’ attorney Daniel “Becket” Becnel told Fox 8.

But later in the afternoon, Kenner officials rejected Becnel’s characterization, saying that the case remains open and that Thomas had instead been entered into a pretrial diversion program. Defendants typically see charges dismissed if they complete terms and conditions of a pretrial diversion agreement, which can vary from case to case.

“The charges against Mr. Thomas were not dismissed, despite the allegations from his attorney,” Kenner City Attorney’s office prosecutor Raymond Canzoneri Jr. said in an email to Fox 8.

Thomas was arrested outside his Kenner home last Nov. 10, accused of shoving a construction contractor, knocking a cellphone from his hand and throwing a brick at the worker’s truck that was allegedly impeding traffic on Thomas’ street. The football player was booked with simple battery and criminal mischief, both misdemeanors.

Becnel said no civil lawsuit has been filed over the alleged incident.

Thomas was released by the Saints earlier this months after his eighth season with the team. He has not signed with another NFL club.
